Heard learned counsel for the petitioner and learned counsel for the respondents.
Petitioner has prayed for the following relief: "For issuance of an appropriate writ/writs, order/orders, direction/directions to concern authority for impartial enquiry against the Vice Chancellor of Purnea University, Purnea by impartial/separate agency like Vigilance or
Patna High Court CWJC No.16865 of 2018(2) dt.06-01-2020 2/3 Central Bureau of Investigation on point of financial irregularity, misuse/misappropriation of public exchequer, illegal appointment of Clerks, P.R.O., O.S.D., Deputy Registrars without post and without proper advertisement and even without sanction post as well as diversion of funds from colleges even against the budgetary provision in garb of muscle man power and additionally by exercise of colourable power even ignoring the statutes right under constitution and also in contravention of State/Hon'ble Chancellor under statutory provision and consequently necessary and appropriate direction may be given to respondents for taking necessary legal action upon the output of enquiry reports within time framed by the Hon'ble High Court and for other necessary relief/reliefs to the basis of the facts and circumstances of case as enumerated and discussed hereinafter."
After the matter was heard for some time, learned counsel for the petitioner submits that petitioner shall be content if a direction is issued to the concerned respondents to consider and decide the representation, which the petitioner shall be making afresh within a period of four weeks from today. Learned counsel for the State states that upon receipt of such request, if any, the same shall be dealt with in
Patna High Court CWJC No.16865 of 2018(2) dt.06-01-2020 3/3 accordance with law, expeditiously and positively within a period of three months from the date of receipt thereof. Equally, liberty is reserved to the petitioner to take recourse to such alternative remedies as are otherwise available in accordance with law.
We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable dispatch.
