JUSTICE GOPAL PRASAD ORAL ORDER 07-08-2015 Heard learned counsel for the petitioners and learned counsel for the State.

Two bail petitions are being heard together and disposed of by common order as two cases arise in connection with Bihariganj P.S. Case No. 228 of 2014 registered under Section 392 of Indian Penal Code.

Learned counsel for the petitioners submits that only

Patna High Court Cr.Misc. No.16120 of 2015 (3) dt.07-08-2015 material against these petitioners is that their names have come on confessional statement of co-accused. Further, it is submitted that there is no recovery from the possessions of the petitioners and no T.I. Parade has been conducted.

Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand)each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-1st Class/Chief Judicial Magistrate, Madhepura, in connection with Bihariganj Police Station Case No. 228 of 2014 corresponding to G.R. No. 275 of 2014, subject to condition that petitioners will file Hazri in the nearest police station once in a fortnight for one years. Further condition that petitioners shall not indulge in such activity in future.
