Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Kawakole P.S. Case No. 331 2019 registered for offence punishable under section 302 of the Indian Penal Code. The informant Chinta Devi lodged FIR, stating therein that when she heard crying of her husband (deceased), she ran away and when she reached the place of occurrence, she saw that the present petitioner was inflicting axe blow on the deceased, who sustaining injury lost his breath.

Patna High Court CR. MISC. No.13134 of 2021(3) dt.22-02-2022 2/2 The learned counsel for the petitioner has submitted that due to previous enmity, the name of the petitioner has been given. He has also submitted that the deceased died due to falling on the stone.

There is specific allegation against the petitioner that he killed the deceased by inflicting axe blows. As such, he is not entitled for privilege of anticipatory bail. Accordingly, his prayer for anticipatory bail is rejected.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
