The petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is in custody since 02.08.2021, charge-sheet has been submitted and is person with clean antecedent and father-in-law of the deceased and husband in the custody. He further submits that the deceased was married to one Bullet Yadav in the year 2020 and it is alleged that after marriage the accused persons including the petitioner were demanding dowry. He further submits that informant is not an eyewitness to the occurrence and the entire allegation hinges around suspicion.
Learned A.P.P. for the State vehemently opposes the
Patna High Court CR. MISC. No.3340 of 2022(2) dt.26-05-2022 2/2 prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and a person with clean antecedent and father-in-law of the deceased and husband is in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Daraundha P.S. Case No. 201 of 2021.
