Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Navinagar P.S. Case No.472 of 2022 dated 04.12.2022 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. 3.

The main submissions advanced by the learned counsel for the petitioner are that the petitioner has fair and clean antecedent and has been languishing in jail since 05.12.2022 and the instant matter relates to recovery of 155.520 litres of country-made wine, though the petitioner is stated to have been arrested from the spot of recovery as a driver of the seized vehicle but he has no concern with the seized wine and he was performing his duty as a driver on the alleged vehicle

Patna High Court CR. MISC. No.3018 of 2023(2) dt.26-04-2023 2/2 and against him the investigation has been completed. 4.

Learned APP appearing for the State has opposed the bail prayer.

Considering the above submissions and mainly the petitioner's fair and clean antecedent and also the fact that against him the investigation has been completed, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Navinagar P.S. Case No.472 of 2022.
