The petitioner seeks bail in a case registered under sections 399, 402 of the Indian Penal Code and 25(1-B)A, 26, 35 of Arms Act. Later on section 414 of the Indian Penal Code was also added.

The police apprehended the petitioner Lalu Sahni along with other accused persons. From the possession of petitioner one loaded country made pistol with two live cartridges were recovered.

Learned counsel for the petitioner submits that similarly situated co-accused namely Nageshwar Bind and Amrik Bind have already been enlarged on bail vide Cri. Misc. No.

Patna High Court Cr.Misc. No.7610 of 2015 (2) dt.26-02-2015 2/2 5370 of 2015. Petitioner is in jail since 18.07.2014. Considering the fact that petitioner has got criminal antecedent but similarly situated co-accused have already been granted bail and petitioner has already remained in bail for more than seven months the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Smt. Sangita Rani, Judicial Magistrate, Ist Class, Patna in Rajeev Nagar P.S. Case No. 114 of 2014.
