JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 Petitioner is languishing in custody since 19.01.2015 in a case registered for the offences punishable under Sections 302, 328/34 of the I.P.C.

It is alleged that the informant has two sons namely Kanhai Singh and Raj Kumar Singh. The petitioner is wife of Kanhai Singh and the ancestral land was partitioned in equal share between them. Though for thirteen decimals of land both the sons used to quarrel. It is alleged that in the background of the said dispute the petitioner came and started abusing Nirmala Devi, wife of the informant. In the meantime, husband of the petitioner came and made assault to Nirmala Devi. This petitioner brought some bottle filled with liquid and asked to administer Nirmala Devi which was administered by Kanhai Singh, the husband of the petitioner which was ultimately found to be poisonous. Considering the fact that accusation under Section 302 I.P.C has not been found true during investigation and the petitioner being a lady, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sanokhar P.S.
