The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 308, 504/34 of the Indian Penal Code.

Prosecution case as lodged by the informant is that on 21.10.2019, seven named accused persons including the petitioner came, abused and assaulted the informant. As a result, the informant received injury on his hand and head. It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case. He submits that both sides are agnates and there is counter

Patna High Court CR. MISC. No.2318 of 2020(2) dt.27-02-2020 2/2 version of the occurrence also being Fatehpur P.S. Case No. 238 of 2019 lodged by the petitioner against the informant's side. The informant has received simple injury and statement has been in para-3 of the bail petition that petitioner has no criminal antecedent.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Xth, Gaya in connection with Fatehpur Police Station Case No. 237 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
