2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.

3. As per the prosecution case, on the alleged date and time of the occurrence, three persons riding on motorcycle came in premises of the High School and started indiscriminate firing creating chaos in the School.

4. Learned counsel appearing for the petitioner submits that at the time of incident, petitioner was in the village and petitioner has falsely been implicated in this case because he is associate of co-accused Dharmendra Bharti. Allegation of firing is general and omnibus and no specific overt act has been alleged against the petitioner. No one sustained fire arms injury. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of

No.2316 of 2025(2) dt.15-02-2025 2/2 arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Siwan in Jamo Bazar Police Station Case No. 300/2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
