2. This petition has been preferred for following reliefs:
For issuance of the writ nature of mandamus for direction to the respondents to grant the compensation of the land, which has been acquire by the respondents bearing Khata No. 248, Khesra No. 1375, Area-0.32 decimal and Khata No. 256, Khesra No. 1374, Area0.09 decimal under the middle irrigation project Bhagalpur for canal and further issue direction to respondent to grant the
Patna High Court CWJC No.17769 of 2016(2) dt.19-08-2025 2/3 compensation of the acquire land of the petitioner alongwith the interest 11% per annum till date full and final payment to the petitioner alongwith the litigation cost and further give other legal consequential benefit to the petitioner.
3. A counter affidavit has come on behalf of the Staterespondent nos.2 to 5, in which it has been recorded that Title (Partition) Suit No.67 of 2016 is presently before a competent Court and as such, the compensation amount has been put on hold.
4. Learned counsel for the petitioner submits that he has preferred a petition before the Collector, Bhagalpur but in the changed circumstance, he be allowed to prefer a fresh petition before the District Land Acquisition Officer, Bhagalpur (respondent no.4).
5. Learned counsel for the State submits that he wants an order, a reason order will be passed by the concerned respondent.
6. In that background, this petition is disposed of allowing the petitioner to approach the concerned respondent no.4, the District Land Acquisition Officer, Bhagalpur in next four weeks, he shall be noticing all the parties and pass the final order at the earliest. He must take into account the present
Patna High Court CWJC No.17769 of 2016(2) dt.19-08-2025 3/3 development that may have taken place in Title (Partition) Suit No.67 of 2016, before coming to the conclusion.
7. This writ petition is disposed of with the aforesaid observation.
