Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Section 7 of the Essential Commodities Act, registered in connection with Bihariganj P.S.Case No. 224 of 2021.

The learned counsel for the petitioner has submitted that from bare perusal of last paragraph of the order of 2nd Additional Sessions Judge, Madhepura passed in ABP No. 1124 of 2021, it is clear that the petitioner was made accused on

Patna High Court CR. MISC. No.3532 of 2022(2) dt.05-08-2022 2/2 suspicion that 77 bags of rice of PDS System was recovered from his go down. It has also been mentioned in that order that the I.O. has not investigated the fact from where illegal rice was procured by the petitioner. The petitioner is a person of clean antecedent.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Madhepura in connection with Bihariganj P.S.Case No. 224 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
