2. The petitioner seeks regular bail in connection with Adapur (Harpur) P.S. Case No. 194 of 2023, lodged on 04.07.2023, under Section 392 of the Indian Penal Code.

3. As per the prosecution, an F.I.R. has been lodged against an unknown accused person, who is alleged to have snatched a motorcycle, mobile phones, and other items.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner has no criminal antecedents and that nothing has been recovered from his possession. It is also submitted that the petitioner's name has figured in the present case solely on the basis of the confessional statement of the co-accused, namely Vishal Kumar, who has already been

Patna High Court CR. MISC. No.6156 of 2025(2) dt.11-04-2025 2/2 granted bail by this Hon'ble Court vide order dated 24.01.2024 passed in Cr. Misc. No. 2113 of 2024. Counsel further submits that the petitioner has not been put on Test Identification Parade (TIP) till date and has been in custody since 29.09.2024. It is further submitted that the offence alleged against the petitioner is magisterial triable in nature.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of 2nd Class Judicial Magistrate, Motihari, East Champaran in connection with Adapur (Harpur) P.S. Case No. 194 of 2023, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
