This is an application for bail in a case of misuse. Earlier the petitioner was granted bail in a complaint case processes were directed to be issued after cognizance being taken for the offences punishable under Sections 147, 148, 149, 323, 441, 379, 380 and 427 of the Indian Penal Code. The bail bond of the petitioner was cancelled on 23.04.2004. The petitioner is now in custody since 06.02.2015. There is nothing on record to suggest that any progress of trial was made from 1994 to 2003 nor from 06.02.2015 till date.

It is submitted by learned counsel for the

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saharsa in connection with Complaint Case No. 581C of 1993. The learned court below will positively cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
