JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-04-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners are seeking regular bail in connection with Ghoghardiha P.S. Case No. 91 of 2022, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 427 and 34 of the Indian Penal Code.

As per allegation, the accused persons blocked the way of the informant. On protest, the accused persons badly assaulted the informant and his wife.

The learned counsel for the petitioners has submitted that petitioners and the informant are full brothers. There was

Patna High Court CR. MISC. No.3659 of 2023(2) dt.07-04-2023 2/3 some disputes between them, but now, all the disputes have been resolved and cordial relation has been restored. Both the parties have compromised the case. The petitioner no. 1 is under custody since 22.07.2022 and petitioner no. 2 is under custody since 22.08.2022.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Jhanjharpur in connection with Ghoghardiha P.S. Case No. 91 of 2022, subject to the following conditions:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioners are found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.

(iii) After release of the petitioners, the learned court

No.3659 of 2023(2) dt.07-04-2023 3/3 below shall verify the criminal antecedent of the petitioners and it comes to the notice of the learned court below that the petitioners are involved in any other case, the learned court below shall be at liberty to cancel their bail bonds.
