Petitioner has filed the present contempt application for compliance of the order passed in C.W.J.C. No. 10308 of 2018 dated 03.08.2018.
Learned counsel for the State on behalf of the opposite party nos. 2, 3 and 4 has filed a show cause wherein the order passed by the Collector dated 29.01.2019 has been annexed as Annexure-A being the order disposing of the Supply Appeal Case No. 21 of 2018.
Counsel for the State submits that the petitioner has not shown any inclination in appearing before the Appellate
Patna High Court MJC No.71 of 2019(3) dt.17-04-2019 2/2 Court in Appeal and had remained absent, hence, the appeal has been disposed of as the petitioner remained absent and was not inclined to proceed with the appeal.
Considering the same, the order passed in the writ application has been substantially complied with. The petitioner is at liberty to challenge the order passed by the appellate court in Supply Appeal Case No. 21 of 2018.
