ANJANA MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 09.11.2015 in connection with Motipur P.S. Case No. 309/2015, registered for the offences punishable under Sections 379, 414, 420, 467, 468, 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that one ATM card was recovered from his conscious possession while he was standing in queue at State Bank ATM. Suspecting the petitioner to be part of a gang whose modus operandi is to replace ATM cards of customers and to withdraw money from ATM, he was taken into custody. It is further submitted that another similarly situated co-accused, namely Vikash Kumar who was also taken into custody at the same

Patna High Court Cr.Misc. No.6166 of 2016 (2) dt.11-02-2016 2/2 point of time has been extended the privilege of regular bail vide order dated 29.01.2016 passed in Cr. Misc. No. 2583/2016. Considering the aforementioned facts and that the petitioner is a man of clean antecedent, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Motipur P.S.
