The petitioners apprehend their arrest in Parsa Bazar P.S. case No. 435/2019 registered under Section 147, 149, 354B, 341, 323, 307, 379, 504 of the IPC.

The informant alleged that the accused persons firstly tried to outrage the modesty of his mother and on protest the accused persons assaulted the informant and others.

No.4562 of 2020(3) dt.10-02-2021 2/2 The learned counsel for the petitioners submits that co-accused Rupesh Ram and Bablu Kumar Das have already been granted anticipatory bail vide order dated 18.06.2020 passed in Cr. Misc. No. 589 of 2020 by a coordinate Bench of this court and same and similar allegations are made against the petitioners. The informant got one injury on his head which is opined to be simple in nature.

Taking into consideration the facts that all the 12 accused persons, including the petitioners, are alleged to have assaulted the informant but the informant got only one injury and two accused persons, namely, Rupesh Ram and Bablu Kumar Das, similarly situated, have already been granted anticipatory bail, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Patna in connection with Parsa Bazar P.S. case No. 435/2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
