The petitioner seeks regular bail in a case registered under Section 379 of the Indian Penal Code.
The informant lodged the case against unknown for the theft of his Hero Honda motorcycle, bearing registration no. BR 43C 5749, from the premises of SBI branch near P.S. College, Madhepura.
It is submitted that the informant had purchased the motorcycle from the petitioner and he suspected that the petitioner might have committed theft of the motorcycle as one of the keys of the motorcycle was kept by the petitioner. It is further submitted that the stolen motorcycle was recovered from the possession of Ugrasen @ Ganesh Mandal from the district of Purnea. The police arrested the petitioner and obtained his
Patna High Court Cr.Misc. No.664 of 2015 (3) dt.19-03-2015 2/2 confession. The petitioner has got no criminal antecedent. It appears that the stolen motorcycle was not recovered from the possession of the petitioner and his confessional statement was recorded after recovery of the stolen motorcycle from the possession of Ugrasen @ Ganesh Mandal. The petitioner is in jail since 20.09.2014.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in Madhepura P.S. Case No. 511 of 2014. (Prabhat Kumar Jha, J) Dilip/- U T
