JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.
The petitioner apprehends his arrest in connection with Pipra P.S. Case No. 192 of 2020, registered for the offences punishable under Sections 341, 342, 504, 506 of the Indian Penal Code and Sections 25(1-b)A, 26 of the Arms Act. As per allegation, the petitioner came to the house of the informant and abused his mother and asked her as to why she spoke ill about him. The further allegation is that he pointed a country made pistol to the temporal region of the mother of the informant and on hue and cry made by the informant's mother, his brother Kishor Shahu reached there and snatched pistol from the hands of the
Patna High Court CR. MISC. No.13245 of 2021(2) dt.10-01-2022 2/2 petitioner but the petitioner became successful in fleeing away. Learned counsel for the petitioner has submitted that for the same day occurrence a counter case has been lodged on behalf of the petitioner which is Complaint Case No. 467 of 2020 against the informant side. The allegation as per the complaint case is that the accused persons badly assaulted the petitioner and snatched his motorcycle. As per Paragraph No. 3 of the bail petition the petitioner has no criminal antecedent.
Considering the above-mentioned facts and circumstances, let the petitioner be released on bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-6th, Supaul in connection with Pipra P.S. Case No. 192 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
