JUSTICE SHIVAJI PANDEY ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In this case the petitioner is seeking bail in connection with Murliganj P.S. Case No.173 of 2015 for the offence under Section 397 of the Indian Penal Code. There is accusation against the petitioner is of road robbery and causing fire arm injuries to the group of the victim. As per the allegation, the counsel for the petitioner submits that he has falsely been implicated in this case. He further submits that co-accused, namely, Sanjeev Yadav @ Dalda has already been granted bail vide Cr.Misc.No.6645 of 2016.He further submits that nothing has been recovered from the possession of the petitioner.

No.7335 of 2016 (3) dt.11-04-2016 2/2 Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Madhepura, in Murliganj P.S.Case No.173/15, G.R. Case No.1364/15) subject to the conditions that (i) if the petitioner is found involved in future in similar type of case, the prosecution will at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (ii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
