JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Purushotampur P.S. Case No. 58 of 2019 for the offence under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.
Allegation against this petitioner is that he was the member of assembly to commit Bank robbery.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the name of the petitioner surfaced in the confessional statement of co-accused Uday Kumar and Biru Kumar, who was apprehended by the police and from their possession loaded country made Katta, live cartridge and mobile phones were

Considering the fact that the petitioner has got no criminal antecedent, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Purushotampur P.S. Case No. 58 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
