2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 363, 366-A of the Indian Penal Code.

3. The prosecution case in brief is that these petitioners along with other co-accused kidnapped the minor

Patna High Court CR. MISC. No.6043 of 2025(3) dt.20-03-2025 2/3 daughter of the informant. It is further alleged that when the wife of the informant went to make complaint against coaccused Gautam Kumar then his family members assaulted and abused informant's wife.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are innocent and have committed no offence. He further submits that the specific allegation of kidnapping is against co-accused Gautam Kumar. There is general and omnibus allegation against these petitioners of assault. As a matter of fact, there was love affair between the victim and the co-accused namely Gautam Kumar. The victim in her statement recorded u/s 164 Cr.P.C. has not taken the name of these petitioners. The petitioners have clean antecedent except petitioner no. 3 has one criminal antecedent and in that case he is on bail.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the aforesaid facts and circumstances, allegation is general and omnibus against the petitioners, the prayer for grant of anticipatory bail to the petitioners are allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of court of A.C.J.M.-IV, Gaya in connection with Khizersarai P.S. Case No. 229 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
