Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406,409,420,467,468,469,471,201,120(B)of the Indian Penal Code.

The FIR reveals an allegation of defalcation and misappropriation of the money of PACS by its Office-bearers and Assistants. The petitioner was Assistant at the time of alleged occurrence and co-accused-Sujay Kumar Singh, having identical allegation, has already been allowed anticipatory bail

Patna High Court CR. MISC. No.2716 of 2020(5) dt.01-10-2020 2/2 by a Coordinate Bench of this Court vide Annexure-2. Submission is that petitioner had no role in the matter of financial decision in the PACS rather his job was clerical one. Petitioner has got no criminal antecedent.

Considering the entire facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bahadurganj P.S.Case No.114 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case and also the petitioner shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
