====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-06-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354 (C), 506, 509 of the Indian Penal Code, Section 3/ 4 of the Dowry Prohibition Act and Sections 66(E), 67, 67(A) of the I.T. Act, 2008.

It is alleged by the informant that she contacted co-accused Md. Qaiser Imam for marriage of her daughter with his son and for that purpose, she gave rupees one lakh in the account of co-accused Quaiser Imam. However, few days before the date of marriage,

Patna High Court CR. MISC. No.13557 of 2021(4) dt.20-06-2022 2/3 co-accused demanded rupees ten lakhs as dowry and when she refused to pay such a huge amount, the pictures and videos of the daughter of the informant got viral by the accused persons.

It is submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. The petitioner is own brother of the informant and he has no concern with co-accused Md. Quaiser Imam. The petitioner has also not negotiated in performance of marriage of the daughter of the informant.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Amas P.S.
