JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 16.09.2014 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

The brother of the informant went missing when the informant and his other brother started searching the missing brother Pradeep Yadav when they saw the petitioner and other accused persons going away with arms, subsequently, the dead body of the missing brother of the informant was recovered. It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled and there is no eye-witness to the occurrence. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named
