Mr.Dilip Kumar No. 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-05-2025 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Marachi P.S. Case No. 83 of 2023, registered for the offences punishable under Sections 302, 386, 34 of the IPC and Section 27 of the Arms Act.

3. Allegedly, in course of fishing, some scuffle took place and in consequence thereof, firing was also made, as a result of which, the informant's son received gun shot injury and died on the spot.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the specific allegation of opening fire causing instant death of the son of the informant is

Patna High Court CR. MISC. No.11622 of 2025(3) dt.15-05-2025 2/2 attributed to Vikash Kumar @ Ghutia. On exactly similar footing, co-accused Lango Nishad @ Lango Bind @ Vakil Sahni @ Langda has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 21921 of 2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM-Ist, Barh, Patna in connection with Marachi P.S. Case No. 83 of 2023, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
