The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 64 of 2019 for the offence punishable under Sections 302/34 of the Indian Penal Code. The allegation is regarding the accused persons having killed the deceased victim lady on account of nonfulfillment of demand for dowry. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 29.06.2019. It is submitted that the petitioner is mother-in-law of the deceased victim lady whereas the fact is that the father-in-law and the brother-in-law

No.1415 of 2020(2) dt.17-01-2020 2/2 of the deceased victim lady have already been granted bail by a co-ordinate Bench of this Court vide order dated 29.08.2019 passed in Cr. Misc. No. 53219 of 2019. It is also submitted that the husband of the deceased victim lady is in custody and the petitioner is languishing in custody since 29.06.2019. Having regard to the facts and circumstances of the case. Considering the submissions made by the learned counsel for the petitioner coupled with the fact that similarly situated coaccused persons have already been grant ed bail by a coordinate Bench of this Court and the petitioner is stated to be having no complicity in the matter, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 64 of 2019.
