The petitioner seeks regular bail in a case registered under Sections 302/34 of the Indian Penal Code. The informant Aprina Khatoon alleged that her brother received a call of Anil Kumar (the petitioner) at his Mobile No. 8651582038. After some time, another person came on a motorcycle and took his brother Taiyab Ansari from his house. Thereafter, Taiyab Ansari did not return and, on the next day, on 05.03.2014 the dead body of Taiyab Ansari was recovered. It is submitted that it has not come in the entire case diary that the petitioner called Taiyab Ansari, the brother of the informant, and thereafter the deceased went along with another person to the house of the petitioner. The other witnesses have simply reiterated the statements of the informant in the case diary but the investigating officer has not collected any further evidence
Patna High Court Cr.Misc. No.824 of 2015 (4) dt.19-03-2015 2/2 to show the involvement of the petitioner in killing of Taiyab Ansari. It has also not come that the petitioner called the deceased and asked him to come. Except suspicion, there is no material against the petitioner.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Nautan (Jagdishpur) P.S. Case No. 49 of 2014.
