The petitioner has invoked the jurisdiction of this Court seeking a direction upon the respondents concerned to extend the statutory interest for the delayed payment of post retiral dues of the petitioner. It is the contention of the petitioner that despite his superannuation from the post of Block Agriculture Officer, Gayghat, Muzzafarpur w.e.f. 31.12.2019 he

Patna High Court CWJC No.1692 of 2024(2) dt.16-01-2025 2/3 has been extended the benefit of Group Insurance as well as gratuity after delay of more than three years.

3. Drawing the attention of this Court to Annexure P/10, an order passed by the District Public Grievance Redressal Authority, it is vehemently contended that the aforesaid authority after deliberation of the matter has observed that the delay has occurred on account of Establishment Assistant.

4. The petitioner also approached the District Magistrate as well as the Commissioner, Tirhut Division, Muzzafarpur for redressal of his grievances and extending the statutory interest over the delayed payment but the same has not been done.

5. A counter affidavit has been filed on behalf of the respondent nos. 1 and 2.

6. The Director Agriculture, Bihar, Patna vide his letter no. 147 dated 22.02.2024 has intimated the District Magistrate, Muzzafarpur and the B.D.O. Gayghat, Muzzafarpur to consider the grievance of the petitioner, but neither the representation of the petitioner has been disposed off nor any counter affidavit is on record on their behalf.

7. Let the District Magistrate, Muzaffarpur consider the representation of the petitioner and pass a reasoned and

8. Suffice it to observe that in case, the claim of the petitioner for interest over the delayed payment finds favour, necessary payment shall be made within the period stipulated.

9. Accordingly, the present writ petition stands disposed off with the aforesaid direction.
