The petitioner apprehends her arrest in connection with Andar P.S. Case No.110 of 2020 registered under Section 414 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to high handedness of police. The petitioner has no concern with the seized liquor. The petitioner has got no criminal antecedent.

Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that altogether 107.60 litres of illicit liquor has been recovered from the motorcycle,

Patna High Court CR. MISC. No.3979 of 2023(2) dt.28-04-2023 2/2 which belongs to the petitioner. Therefore, the petitioner does not deserve anticipatory bail.

Having considered the above facts and circumstances of the case as well as nature of the allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, her prayer for bail is rejected. (Arvind Srivastava, J) Harish/- U T
