2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 363, 366A of IPC and section 8 of POCSO Act .

3 . The brief allegation against the petitioner is that on 03.01.2024 at about 06:00 AM, he, along with three unidentified miscreants armed with weapons, arrived at the Informant's doorway in a Bolero vehicle. It is alleged that while the

Patna High Court CR. MISC. No.1977 of 2026(6) dt.22-06-2026 2/3 Informant and his minor daughter, aged about 16 years (hereinafter referred to as the 'victim'), were basking in the fire, the accused persons, on the point of gun, kidnapped the victim.

4. Learned counsel for the petitioner submitted that as a matter of fact, petitioner is innocent and has committed no offence as alleged. It is further submitted that during investigation, statement of the victim was recorded under Section 164 of Cr. PC, wherein she stated that in the month of January 2024, she eloped with the petitioner and solemnized marriage with him and thereafter, they went to Manipur and started living as husband and wife whereafter, she gave birth to a baby.

5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, statement of the victim recorded under Section 164 Cr.P.C. and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th District & Additional Session Judge Cum Spl. Judge POCSO Act, East Champaran,
