This application for grant of regular bail arises out of Khodawandpur P.S. Case No. 165 of 2019 registered for the offence punishable under Sections 120(B), 302, 201/34 of the Indian Penal Code.
The petitioner is father-in-law of the deceased. He is in custody since 17.08.2019. It appears from the First Information Report that there was serious matrimonial dispute between the petitioner's son and the deceased. There were cases filed by both of them either for seeking divorce or for grant of maintenance and for other reasons. Attempts were made to reconcile the matrimonial dispute between the two. It is alleged in the First Information Report that on
Patna High Court CR. MISC. No.4691 of 2020(5) dt.08-07-2020 2/3 14.09.2019, the mobile phone of the deceased was found by the informant to be switched off. It is also alleged that the informant had gone to the matrimonial home of the deceased and when enquired about her whereabouts, but he could not get any satisfactory reply by the in-law.
Learned counsel appearing on behalf of the petitioner, referring to the First Information Report, has submitted that apparently the petitioner has been implicated because he is father of the husband of the deceased. There is no specific allegation against the petitioner in the First Information Report.
Case diary has been called for, which is there on record.
It does not appear on perusal of the case diary that there is any specific material against the petitioner of his involvement, which can be a basis for refusing his prayer for bail.
Considering the facts and circumstances, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the
