The petitioners are languishing in custody since 13.08.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
On information that the dead body of the informant's husband is lying in the eastern side of the village, the informant went and found the dead body with gun shot injuries on the head. The informant suspected the hands of these petitioners in the alleged offence as they have some fight with the husband of the informant with regard to football game when the petitioners
Patna High Court Cr.Misc. No.1878 of 2015 (02) dt.16-01-2015 2/2 threatened. It is also alleged that near the place from where the dead body was recovered Rajan Yadav ploughing field one day prior to the occurrence.
It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled. The impugned order also suggests that the case is of circumstantial evidence.
Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Hilsa P.S. Case No. 313 of 2014.
