The present petition has been filed for transfer of Title Appeal No. 47 of 2017 pending in the Court of Additional District Judge-XI, Patna, from Patna Civil Court to Danapur Civil Court.
It has been submitted by the learned counsel for the petitioner that the appeal is to be heard in the Sub-Divisional Court, Danapur as the matter arises out of properties of Paliganj and the records have not been transferred to Danapur yet. The learned counsel for the other side submits that the matter be decided by the Learned Additional District Judge, who is hearing the matter in Patna, Sadar Only.
Patna High Court MJC No.3313 of 2018(5) dt.11-07-2022 2/2 Considering the facts of the case that the jurisdiction is of learned Additional District Judge at Danapur. Let this case be transferred to the Court of Additional District Judge, 1st at Danapur.
Both the parties shall appear before the Additional District Judge at Danapur on 01.08.2022 and on that date they shall be fixed by the Additional District Judge 1st for hearing of the Title Suit Appeal.
Communicate this order to the Patna District Judge, by FAX for compliance.
With the aforesaid observation and direction, this transfer application is allowed.
