Petitioner seeks bail in Wazirganj P.S. Case No. 521 of 2016 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

Allegation against the petitioner is of killing the daughter of the Informant for non fulfillment of demand of dowry along with FIR named accused.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on mere suspicion. The petitioner has not demanded any dowry. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 10.05.2017 in Criminal Miscellaneous No. 21203 of 2017 and 07.03.2018 in Criminal Miscellaneous No. 11097 of 2018. Petitioner is in

Patna High Court Cr.Misc. No.137 of 2019(6) dt.21-02-2019 2/2 custody since 28.08.2018.

Considering the fact that petitioner is husband and it is his responsibility to look after his wife, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the trial court is directed to expedite the trial of the petitioner and conclude the same within a period of one year from the date of receipt of this order. (S. Kumar, J) ranjan/- U
