The petitioner seeks regular bail in connection with Matihani P.S. Case No. 140 of 2019 for the offence registered under Sections 25(1-B)A, 26 and 35 of the Arms Act. The allegation is regarding recovery of 3 live cartridges from the pocket of the petitioner. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that though the petitioner is an accused in two other cases but he is on bail in the said cases. It is also submitted that the charge sheet has already been submitted in the present case. Lastly, it is submitted that the petitioner is languishing in custody since 07.09.2019.
Patna High Court CR. MISC. No.1206 of 2020(2) dt.16-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the nature of accusation, I deem it fit and proper to direct for release of the petitioner herein on regular bail.
Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Begusarai in connection with Matihani P.S.
