JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 420 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, this petitioner in connivance with her husband defalcated Rs. 20 lacs from petrol pump of the informant and purchased a truck in her name. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is neither staff of the petrol pump nor she is agent of the company and she has no concern with the affairs of the petrol pump. No chit of paper has been shown regarding cheating of Rs. 20 lacs from the petrol pump. As a matter of fact
Patna High Court CR. MISC. No.3443 of 2022(2) dt.31-03-2022 2/2 on 15.05.2020 the informant with his associated forcibly took away truck of the petitioner and confined her husband in his house for which complaint case No. 254-C was lodged on 25.05.2020 and after coming to know this fact in order to save his skin from the complaint case present case has been lodged against the petitioner and others. Petitioner claims clean antecedent and is in custody since 04.10.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Khagaria in connection with Maheshkhunt PS case No. 87/2020.
