08-07-2015 Seen the report submitted by Registrar General and perused the order dated 04.03.2015 passed by this Court in Cr. Misc. No. 47070/2014.
Heard Sri Akhileshwar Prasad Singh, learned Senior Counsel, who appears and submits that a Lawyer acts on instruction of the client and, if wrong instructions are given, it is difficult for a Lawyer to ascertain the truth. The mistake, if any, on the part of
Patna High Court Cr.Misc. No.47070 of 2014 (6) dt.08-07-2015 - 2 - the Lawyer could at best be of not taking due care, but, no criminality or misdemeanor can be attributed. This is the responsibility of his client or Pairvikar who are supposed to be knowing the facts and who are supposed to disclose the truth.
Having considered the matter, so far as involvement of Advocate-on-Record and the Advocate Clerk of Cr. Misc. No. 1647/2015 is concerned, under the aforesaid circumstances it does not call for any action. The rest of the report is accepted. Let the matter be proceeded accordingly.
