JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code and 30(c) of Bihar Prohibition and Excise Act, 2016. Petitioner and two others are said to have snatched rupees twenty three thousand and mobile from the informant while they were in drunken state.
Submission on behalf of the petitioner is that petitioner does not have any criminal antecedent and is languishing in jail custody since 13.08.2018. It is also submitted that as a matter of fact, no such occurrence ever took place and the petitioner has been implicated in this case as some
Patna High Court Cr.Misc. No.265 of 2019(2) dt.17-01-2019 2/2 altercation had taken place between the informant and petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Purnea in connection with Special Excise Case No. 763 of 2018 arising out of K. Hat Sahayak P.S. Case No. 574 of 2018.
