JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-01-2019 Considering the fact that the direction of this Court has been complied with, no further indulgence is required. The issue as to grant of benefit w.e.f. the date of the order of the Appellate Authority in Appeal No. 03 of 2016 or from the prospective dates cannot be decided in the present proceeding. However, liberty shall be available to the petitioner to approach the appropriate forum including the writ Court for such grievance.
In view of the above, the petitioner would be at liberty to challenge the order in appropriate proceeding, if he is in any
Patna High Court MJC No.3320 of 2018(2) dt.17-01-2019 2/2 manner aggrieved by the decision. So far as the intervenor is concerned no indulgence can be granted in this proceeding. If he is aggrieved by the decision in purported compliance of direction of the District Teachers Employment Appellate Authority liberty shall be available to challenge the same in appropriate proceeding.
With the aforesaid, the present application stands disposed of.
