Earlier bail application of the petitioners was rejected vide Cr. Misc. No. 44087 of 2015, order dated 01.12.2015. The petitioners being in custody since 04.07.2015 but due to inadvertent mistake in the earlier order it had been mentioned as 02.08.2015. The earlier bail application of the petitioners was rejected with an observation 'rejected at this stage'. A report has been called for from the court below which is at Flag-'A'. From perusal of the same, it is evident that the
Patna High Court Cr.Misc. No.5727 of 2016 (3) dt.02-03-2016 2/2 charge has been framed in the case and the summons have been issued upon the prosecution witnesses.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the earlier observation, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 10th Additional District & Sessions Judge, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 584/2015(Sessions Trial No. 33/2016). Anyhow, the petitioners shall be present in the court below on each and every date fixed by the trial court and shall cooperate in course of trial. If the petitioners fail to appear on two consecutive dates the trial court shall be at liberty to cancel the bail of the petitioners.
