JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Petitioner is languishing in custody since 20.08.2014 in a case registered for the offences punishable under Sections 395, 397 of the I.P.C.
It is alleged that accused persons robbed the cash, mobiles of the informant and the passengers of Tata Magic vehicle.
During investigation the petitioner was apprehended when he confessed his guilt.
It is submitted by learned counsel for the petitioner that neither recovery has been made from the petitioner nor the petitioner has been put on T.I.P. The statements to that effect have been made in para 7 and 8 of the petition and after petitioner being roped in the present case, he has been made accused in three other cases.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.4944 of 2015 (2) dt.05-02-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria(Bairgachhi) P.S. Caes No. 326 of 2014.
Since the petitioner has criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during trial.
