2. For the reasons stated in the application read with the affidavit, delay of about 67 days in filing LPA No. 1219 of 2018 stands condoned. I.A. No. 6559 of 2018 is allowed.
3. Service of notice to respondent no. 1 treated as held sufficient vide our order dated 19.06.2024. There is no representation on behalf of respondent no. 1/ Suraj Kumar.
4. Learned counsel for the petitioner submitted that the present matter is covered by co-ordinate Bench decision passed in L.P.A. No. 778 of 2018 on 21.02.2023.
5. Accordingly, order of the learned Single Judge dated 07.05.2018 passed in CWJC No. 8605 of 2018 stands set aside and the present LPA allowed in terms of the co-ordinate Bench decision passed in L.P.A. No. 778 of 2018 on 21.02.2023.
