2. The petitioner apprehends his arrest in a case registered for the offence under Sections 338, 336(3), 340(2), 318(4), 61 of the Bhartiya Nyaya Sanhita, 2023.
3. It is alleged that this petitioner was candidate for recruitment in Bihar Homeguard at Sitamarhi and he managed co-accused Santosh Kumar Yadav for appearing in physical test by offering him handsome amount and thereafter, co-accused Santosh Kumar Yadav appeared in physical test on behalf of petitioner, but during inquiry, he was caught by the recruitment agency.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.2758 of 2025(2) dt.15-02-2025 2/2 petitioner has been made accused in this case on the basis of confessional statement of co-accused Santosh Kumar Yadav, who was arrested on spot. Petitioner has been falsely implicated in this case and has got no concern with him. The alleged manipulation in the Aadhar Card of petitioner was done by coaccused. Petitioner is simply a victim of circumstances. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Dumra P.S. Case No. 415 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
