====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 26-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offence punishable under Section 3 of the R.P.U.P. Act. Learned counsel for the petitioner submits that the petitioner is in custody since 26.07.2021, charge-sheet has been submitted and has antecedent of one case.

The informant alleges that on 25.07.2021, on the basis of secret information, he apprehended the petitioner and Ganaur Mahto from the place of occurrence while they were loading iron pieces of railways on their auto. Further, they disclosed that they were going to sell the stolen article in a scrape shop owned

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and nothing has been recovered from the conscious possession of the petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.07.2021, charge-sheet has been submitted and the nature of allegation, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hajipur (R.P.F.) P.S. Case No. 07 of 2021.
