29-03-2022 Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the offence under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, two unknown miscreants came on a motorcycle and one of them took out pistol and fired upon the informant, as a result of which, he sustained injury on his right shoulder and thereafter, both accused fled away. It is submitted on behalf of petitioner that name of the petitioner has transpired during course of investigation. This petitioner has been made accused only because he is friend of one Mahesh Kumar, who is alleged to have illicit relation with wife of the informant. Petitioner claims clean antecedent and he is in custody since 31.08.2021. Investigation is complete.

Patna High Court CR. MISC. No.3056 of 2022(2) dt.29-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 437 of 2021.
