1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.
3. Learned A.P.P. for the State submits that a counter affidavit is being filed on behalf of the Station House Officer, Pipra Police Station, East Champaran at Motihari which has been filed through Mr. Chandra Bhushan Prasad, learned A.P.P. It is further submitted that the victim has been recovered and she has not supported the case of the prosecution on which learned counsel appearing on behalf of the petitioner submits that the petitioner and the victim were in love and they had eloped but on account of institution of the present false case, the victim came back and her statement was recorded under Section
Patna High Court CR. MISC. No.4424 of 2025(3) dt.28-02-2025 2/2 183 of the BNSS wherein she has not supported the case of the prosecution.
4. After hearing the learned counsel for the parties, let the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Pipra P.S. Case No. 114 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
5. The personal appearance of the Station House Officer, Pipra Police Station, East Champaran at Motihari and the Investigating Officer of the case is dispensed with. (Satyavrat Verma, J) Kundan/- U T
