Mr.Sri Nawal Kishore Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Bihpur (Bhawanipur) P.S. Case No. 273/2018, instituted for offences under Section(s) 448, 342, 323, 307, 497, 504 and 120B/34 of the Indian Penal Code. It is alleged in the written report that second son of informant was married with this petitioner. After marriage his son was tortured by this petitioner on account of which he became mentally weak. It is further alleged that this petitioner developed illicit relationship with one Chandan Kumar Sharma. On the date of occurrence, informant found this petitioner with Chandan Kumar were attempting to commit murder of his son by pressing his neck.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.104 of 2019(2) dt.18-01-2019 2/2 vague and general allegation has been levelled against this petitioner.

Injury report of victim is annexed as Annexure-2, wherein doctor has found one abrasion over neck and bruise over upper part of chest of victim. Injuries are opined to be simple in nature.

Petitioner is in custody since 25.06.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge, Naugachia, Bhagalpur in connection with Bihpur (Bhawanipur) P.S. Case No. 273/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
