The petitioner seeks bail in anticipation of his arrest in connection with Kurhni P.S. Case No. 91 of 2019 dated 20.02.2019 instituted for the offences under Section 392 of the Indian Penal Code.

The petitioner has not been named in the FIR. His accusation in this is only on the basis of confession of one Rahul Kumar, an arrested accused person.

Pursuant to the aforesaid confession, Rs.14,000/- has been recovered from the house of the petitioner. Learned counsel for the petitioner has submitted that it is not the looted money. In fact the money belongs to the family.

Patna High Court CR. MISC. No.13022 of 2021(2) dt.24-12-2021 2/2 However regard being had to the fact that the petitioner was earlier made an accused in a case of similar nature, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the Court below and seeks bail, all the grounds noted above shall be taken into account without being prejudiced by the fact that the present petition on his behalf has not been entertained.
