A very elaborate argument was advanced on behalf of the petitioner but fardbeyan of the informant appears to be dying declaration in which he very specifically stated that this petitioner along with co-accused opened fire causing injury on his abdomen as well as on the buttock of rickshaw puller.

Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to grant the privilege of bail to the petitioner and hence, his prayer for bail in connection with Buxar Town P.S. case no. 347/2009 pending in the court of the Chief Judicial Magistrate, Buxar stands rejected..
